THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3204 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue writ of Mandamus to declare action of the 3rd respondent in not releasing the vehicle bearing No.TS-03-UA-8970 in favour of the petitioner for interim custody is illegal, arbitrary and in violation of Article 14 of the Constitution of India and consequently direct the 3rd respondent to release the vehicle bearing No.TS-03-UA-8970 in favour of the petitioner for interim custody on furnishing personal bond."

Heard, Sri V.V.N. Narayana Rao, learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.

The complaint in the Writ Petition is despite Memo bearing File.No.F1/2064/2016, dated 04-10-2016 of the 2nd respondent the vehicle of the petitioner is not being released. A suggestion is made by learned Government Pleader for Civil Supplies that the petitioner herein may approach the 3rd respondent herein by way of application to take action in terms of the said Memo, dated 04-10-2016 and the same will be considered, in accordance with law.

For the aforesaid reasons, the writ petition is disposed of, keeping it open for the petitioner herein to make necessary application before the 3rd respondent for implementation of the orders vide Memo, dated 04-10-2016 within a period of one week from the date of receipt of a copy of this order and if any such representation is made within the time stipulated the same shall be considered and appropriate action be taken by the 3rd respondent, in accordance with law, within a period of one week thereafter.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
