HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4862 OF 2017 ORDER:

The case of the petitioner is that he filed appeal before the 3rd respondent against the resumption orders passed by the 4th respondent in RC.No.B/646/2015, dated 15.03.2015 along with stay petition. As the same is not being disposed of present writ petition is filed.

Learned counsel for the petitioner submits that without issuing any notice to the petitioner, the impugned resumption orders are passed by the 4th respondent and that though statutory appeal filed against the said order by the petitioner, is pending before the 3rd respondent, the respondent authorities are trying to interfere with the possession of the petitioner over the subject land.

Heard learned Assistant Government Pleader for Revenue.

In view of the aforesaid facts and circumstances the 3rd respondent is directed to dispose of the stay petition/appeal filed by the petitioner, in accordance with law, within a period of two months from the date of receipt of a copy of this order. Till then, Status quo, obtaining as on today shall be maintained by both the parties in respect of the subject land.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
