This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to grant bail to the petitioner/accused No.1 in Crime No. 117 of 2025 on the file of Nallakunta Police Station, Hyderabad, registered for the offences punishable under Section 8(c) read with 20(b)(ii)(B) read with 22(c), 27(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the respondent-State. 3.

The brief facts of the case are that on 28.04.2025, at about 08:00 hours, on receiving credible information that the accused persons are illegally transporting and selling the contraband to the public to earn money in ease manner, the Police have seized 1346 grams of OG weed ganja, 44 LSD Blots, 389 grams of magic mushrooms, 6 mobile phones, net cash of Rs.10,640/- from accused Nos.3 to 6 near main gate of Mother Diary Park, Nallakunta, Hyderabad. Later, on the alleged confession of accused No.3, the petitioner/accused No.1 was apprehended. Hence, the complaint.

Learned counsel for the petitioner submits that though the petitioner is standing on the same footing of accused Nos.2 to 5 who were enlarged on bail in the present crime by this Court vide Criminal Petition Nos.6702, 6705, 8997 and 8604 of 2025 subject to certain conditions, he has been languishing in jail since 05.04.2026. He further contended that the petitioner is innocent and he is falsely implicated in

the present case solely based on the confession of accused No.2, who was enlarged on bail by this Court vide order dated 25.07.2025 in Criminal Petition No.8997 of 2025. He also submitted that the petitioner is willing and ready to cooperate with the investigation and also ready to abide by the conditions, which are going to be imposed by this Court. Hence, learned counsel prays this Court to allow the Criminal Petition by granting bail to the petitioner.

Per contra, learned Additional Public Prosecutor contended that the petitioner/accused No.1, along with his associates/accused Nos.2 to 5, committed grave offence under the provisions of NDPS Act. Hence, he prays this Court to dismiss the Criminal Petition.

In the light of submissions made by both the parties and upon perusal of the material available on record, it is noteworthy that accused Nos. 2 to 5 vide orders dated 09.06.2025, 25.07.2025 and 18.07.2025 in Criminal Petition Nos.6702, 6705, 8997 and 8604 of 2025 were enlarged on bail in the same crime with similar allegations.

Considering the facts and circumstances of the case and since the petitioner is languishing in jail from 05.04.2026, this Court deems it fit to grant bail to the petitioner/accused No.1 subject to the following conditions:

1) The petitioner/accused No.1 shall execute a personal bond for Rs.30,000/- (Rupees Thirty thousand only) with two sureties for a like sum each to the satisfaction of the learned Metropolitan Sessions Judge, Hyderabad at Nampally.

2) The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m., and 05:00 p.m., for a period of eight

(8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter as and when required.

3) After release, if the petitioner/accused No.1 indulges in similar offence, the respondent-State is at liberty to file an application seeking cancellation of the bail granted to him by this Court.

4) The petitioner shall abide by the other conditions stipulated in Section 480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
