This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.3 in Crime No.77 of 2025 of Mallapur Police Station, Jagtial District, registered for the offences punishable under Sections 318(4), 308(5), read with Section 3(5) of the BNS and Sections 10, 24 of Emigration Act.

The case of the prosecution is that, on 10.05.2025 at about 8:00 P.M., Doude Arjun (de-facto complainant), an agriculturist, reported that Argula Bojaram and his associates, including Pabba

Bhumesh and Pabba Swapna, cheated him and others by falsely promising overseas jobs in Dubai through licensed agencies. The accused No.1 allegedly collected Rs.6,00,000/- from the de-facto complainant and additional amounts from other victims such as Chintala Shiva Kumar and Donkena Ajay for arranging employment visas and jobs in Dubai. On 26.05.2022, the victims travelled to Dubai, where they were received by one Bhumesh and accommodated in camps at Alquoz area. The accused No.1 later demanded an additional amount of Rs.3,00,000/- from the de-facto complainant, which was allegedly paid through cheque transactions, including cheque numbers 237938, 237939, and 237940. The de-facto complainant stated that the accused No.

1 only provided company visas, opened bank accounts, and issued credit cards, but failed to provide the promised jobs or salaries. Whenever questioned about employment, the accused No.1 allegedly kept postponing the matter. Later, Bhumesh allegedly threatened the victims to leave Dubai within 24 hours and threatened to kill them if they refused. Out of fear, the de-facto complaint and others returned to India. On 06.03.2025, when the victims approached Bojaram - Accused No.

their money, he allegedly threatened them by saying that a case had been registered against them in Dubai and demanded another Rs.1,00,000/-. Hence, the de-facto complainant requested for necessary action. Basing on the said complaint, the police registered a case for the above said offences. 3.

Heard Sri N. Manohar, learned counsel appearing on behalf of the petitioner as well as Mr. Jithendar Rao Veeramalla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that all the allegations are leveled against the accused No.1 only and that no allegation is leveled against the petitioner and hence, prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioner stating that the allegations against the petitioner are serious in nature and prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it is found that no specific overt acts are made against the petitioner in the complaint. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Mallapur Police Station, Jagtial District, within two weeks from today, and on such surrender, the said Station House Officer shall release her on bail on executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only), with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the

Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 A.M, and 05:00 P.M., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
