ORDER

This writ petition under Article 226 of the Constitution of India is filed for the following relief:

".....to issue an appropriate writ, order or direction more particularly in the nature of writ of mandamus declaring the Respondents' action of deducting the amount towards Contractor's contribution of Employees' Coal Mines Provident Fund in the bills for the work of transportation of coal deployment of 5 nos of 55HP tractor with blade attachment on hire basis for a period of 2 years pursuant to Purchase Order No.7500034888 dated 29.03.2017 as illegal, arbitrary and contrary to the Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 and consequently direct the respondents not to deduct the amounts towards CMPF and pass such other or further orders".

When the matter is taken up for hearing, Sri J. Srinivasa Rao, learned Standing Counsel for the respondents, submits that in similar circumstances, this Court has disposed of W.P.No.35058 of 2016 on 16.11.2016, by following the order dated 30.03.2011, passed by this Court in W.P.No.11107 of 2009 and batch, which fact has not been disputed by the learned counsel for the petitioner. 3.

In those circumstances, recording the submission made by the learned Standing Counsel for the respondents, without expressing any opinion, the Writ Petition is disposed of, in terms of the order of this Court in W.P.No.35058 of 2016 dated 16.11.2016. Office to tag a copy of the order passed in W.P.No.35058 of 2016 to this writ petition. No order as to costs.
