Counsel for the petitioner seeks leave of the Court to withdraw this criminal petition with a liberty to file fresh criminal petition having regard to the recent decision of the Supreme Court reported in DASHRATH RUPSINGH RATHOD v. STATE OF MAHARASHTRA AND ANOTHER.

In that view of the matter, this criminal petition is dismissed as withdrawn granting liberty to the petitioner to file a fresh criminal petition in appropriate Court.
