HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Contempt Case No. 408 of 2016 Order:

This Contempt Case is filed alleging non-implementation of the order in W.P.M.P.No.42322 of 2015 in W.P. No.32776 of 2015 dated 07.10.2015.

When the Contempt Case was listed on 15.07.2016, this Court directed listing of the case along with W.P.No.32776 of 2015. Thereafter, the roster was changed and the Writ Petition was listed before another Court. However, on the orders of the Hon'ble the Acting Chief Justice the case is posted before this Court. The said case is listed along with W.P.No.14948 of 2015, wherein W.V.M.P.No.520 of 2016 was filed. This Court, by order dated 21.10.2016, in W.P.M.P.No.3442 of 2016 filed for clarification of the order in W.P.M.P. No.19410 of 2015 in W.P.No.14948 of 2015 dated 02.06.2015, passed an order clarifying that the order in W.P.M.P.No.19410 of 2015 dated 02.06.2015 was confined only to the petitioner therein and that could not preclude the second respondent from taking action against others pursuant to the surcharge order dated 11.11.2013. In view of the said order, WPMP No.42322 of 2015 was adjourned.

Today, when the Writ Petitions came up for consideration, learned Government Pleader produced before this Court a letter dated 11.11.2016 of the District Cooperative Officer issued to the Special Commissioner for Cooperation and Registrar of Cooperative Societies, A.P., Guntur informing him that the Divisional Cooperative Officer, Proddatur stated in his letter dated 03.11.2016 that E.P.No.2/2016-2017 was filed against two individuals who are not petitioners in W.P.No.32776 of 2015.

ARLR, J CC No. 408 of 2016 In view of the said orders passed by the District Cooperative Officer in consideration of the representation of the petitioner dated 22.08.2015 which was directed to be considered in W.P.M.P.No.42322 of 2015 in W.P.No.32776 of 2015 dated 07.10.2015, no further proceedings are required in the present Contempt Case and, accordingly, the Contempt Case is closed. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Contempt Case shall stand closed.
