This writ petition is filed under Article 226 of the Constitution of India, with the following relief:
"To issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not appointing the Evaluation Committee to determine the market value for the purpose of registration before passing the award of the compensation since four years in respect of the land admeasuring Ac.3.82 gts in Sy.No.72/6B and Ac.0.73 gts in Sy.No.72/7A, in Gavaravaram village in Koyyalagudem Mandal in West Godavari District as arbitrary, illegal, violation of Articles 14, 21 and 300-A of the Constitution of India in the interest of justice". 2.
It is submitted by the learned counsel for the petitioner that the Respondent authorities are not taking into consideration the present market value of the properties for quantification of the compensation amount. On the other hand, it is submitted by the learned Government Pleader since the award enquiry is pending, it is open for the petitioner to raise all his objections before the appropriate authority under the provisions of Right to Fair Compensation, Rehabilitation and Resettlement Act 30/2013. 3.
In view of the above, the writ petition is disposed of, permitting the petitioner herein to raise all his objections before the appropriate authority under the provisions of Right to Fair Compensation, Rehabilitation and Resettlement Act 30/2013 and it is for the Respondent authorities to consider and pass appropriate orders on the same, in accordance with law. As a sequel, the Miscellaneous Petitions, if any, shall stand closed. There shall be no order as to costs.
