HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE WRIT PETITION No. 6949 of 2011 ORDER:

Mr.M.A.Muqtadir, learned counsel holding for Mr.K.Umapathy, Advocate on record for the petitioner, prays for adjournment. When I refused adjournment, he expressed his inability to address the Court. I have perused the writ petition. The prayers made in the writ petition read thus:

"For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue an order or direction, more particularly, one in the nature of Writ of Mandamus:

(i) to declare the action of the respondent corporation in declaring the 3rd and 4th respondents as eligible candidates for selection of distribution of Rajiv Gandhi Rural LPG distribution at Thavanampalli/Eguvathavanampalli Village, Chittoor District, as illegal and impermissible; (ii) and declare the action of the respondent corporation in proceeding with section of the 3rd respondent as distributor without considering the objections of the petitioner and though the same is pending before the Grievance Redressal Committee, as illegal, improper and arbitrary, and pass such other order or orders as this Hon'ble court may deem fit and just."

This Court on 21.03.2011, had granted order of status quo for a period of four weeks. Thereafter, interim order was not extended.

Keeping that in view and considering the nature of prayers, in my opinion, the petitioner seems to have lost interest in prosecuting this matter further and hence, learned counsel for the petitioner is not in a position to address the Court on merits.

In the circumstances, the writ petition is dismissed for non-prosecution.
