This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, "BNSS"), seeking to grant pre-arrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.38 of 2026 on the file of Kodair Police Station, registered for offences punishable under Sections 420, 406, 409, 468, 471 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor appearing for the respondent -State.

The brief facts of the case are that basing on a complaint lodged by the de facto complainant stating that she has two daughters namely B.Vasudha and B.Krishnaveni and on their names, the petitoner/accused No.1 submitted fabricated documents saying that their marriage was performed on 12.03.2023 and 04.12.2022 respectively, and claimed benefits under Kalyana Laxmi Scheme and dishonestly obtained Government Funds in collusion with some agents and other beneficiaries.

Learned counsel for the petitioner/accused No.1 submits that petitioner is innocent and has been falsely implicated in the present case. He further submits that petitioner is ready to abide by any conditions that may be imposed by this Court and shall cooperate with the Police Authorities in the event of she being enlarged on bail. 5.

Learned Additional Public Prosecutor opposed bail stating that basing on fabricated documents, the petitioner/accused No.1 and others have illegally gain

amounts from the Government Kalyana Lakshmi Schemes. Evidently, except Section 409 of Indian Penal Code, the other alleged offences are less than punishment of seven years, however, Section 409 of IPC is not attracted that has to be determined by conducting proper investigation. 6.

In that view of the matter, since prima facie, the ingredients of section 409 of IPC has not made out in the concerned view of this Court. However, the said crime may be investigated and proper charge sheet may be laid. In considered opinion of this Court, it is a fit case to enlarge the petitioner/accused No.1 on bail, by imposing the following conditions:- (i) The petitioner/accused No.1 shall surrender before the respondent police authorities on or before 15.06.2026 and execute a personal bond for Rs.10,000/- (Rupees Ten thousand only) with two local sureties for like-sum each to the satisfaction of Kodair Police Station, Nagarkurnool District and on such surrender, the petitioner/accused No.1 shall be enlarged on bail.

(ii) The petitioner/accused No.1 shall appear before the respondent-Police Authorities on every Sunday from 10.00 A.M. to 2.00 P.M., for a period of six weeks from enlargement from the judicial custody and shall

cooperate with the Investigating Agency as and when she is directed to be present for investigation. (iii) The petitioner/accused No.1 shall not hamper with the investigation and shall not in any way meddle with any of the witnesses and shall cooperate at all times whenever called by the Police for investigation. iv) The petitioner/accused No.1 shall abide by the conditions stipulated under Section 480(3) of the BNSS.

(v) In the event of breach of any of the above conditions, the police authorities are at liberty to file appropriate application for cancellation of bail granted to the petitioner.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
