This writ petition is filed seeking writ of mandamus declaring the action of the 3rd respondent in not mutating the petitioner's name in revenue records in respect of the lands covered in claim 6-A submitted along with the petitioner's representation dated 02.09.2015 as illegal and arbitrary and consequently to direct the 3rd respondent to forthwith mutate his name in revenue records and grant him pattadar pass books and title deeds in respect of the subject land, without insisting prior permission from the 2nd respondent.
It is the case of the petitioner that he filed a representation dated 02.09.2015 along with claim petition under 6-A under the provisions of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 for mutation of his name in record of rights and also for issuance of pattadar pass books and title deeds in respect of the properties mentioned in the affidavit filed in support of the writ petition. It is stated that the 3rd respondent issued notice to the petitioner as well as effected parties i.e., implead petitioner-4th respondent, who was impleaded in this writ petition by virtue of orders of this Court today in W.P.M.P.No.13341 of 2017. It is stated that in pursuant to application filed by the petitioner, 4th respondent also filed objections.
Heard learned counsel for the petitioner, learned Assistant Government Pleader for Revenue and Sri Srinivasulu Kurra, learned counsel for the 4th respondent.
In view of the same, the 3rd respondent is directed to dispose of the application filed by the petitioner, after issuing notice to the petitioner and 4th respondent and by considering the objections filed by the 4th respondent, and pass appropriate orders in accordance with law.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 03.04.2017 kvs
