HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21928 OF 2017 O R D E R :

This Writ Petition is filed challenging the Tender Condition (iii) under para 3 in G.O.Rt.No.180, dated 19.06.2017, of the Tender e-procurement Notice No.17/E-in-C/Core Network/2017, dated 02.06.2017 and to suspend the operation of the said condition. When the matter is called, it is represented by the learned Government Pleader for Roads and Buildings that the respondent authorities have taken a decision to withdraw the impugned tender notification, as such, the cause in the writ petition does not survive. Recording the aforesaid submission of the learned counsel, the writ petition is dismissed. However, this order will not preclude the petitioners from challenging the issuance of fresh tender notification along with G.O.Rt.No.180, Transport, Roads & Buildings (R.I) Department, dated 19.06.2017. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
