THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.15513 of 2011 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, challenging the interference of the respondents during the construction by the petitioner in his property at Plot.No.A38 (part), Sy.No.9/1/I (new), Sivapuri Colony, adjacent to Haripuri Colony, Sarrornagar, Ranga Reddy District, without issuing any notice and without following the due procedure as contemplated under the Hyderabad Municipal Corporation Act, 1955.

Heard and perused the material available on record. Earlier, this Court passed an interim order, dated 09-06-2011 in W.P.M.P.No.18596 of 2011 in W.P.No.15513 of 2011 as follows:

"Pending further orders, there shall be stay of demolition of the structures in question. However, the petitioner shall not proceed with any further construction contrary to the sanctioned plan until further orders."

Considering the earlier interim order, if there is any deviation in the construction made by the petitioner herein, contrary to the sanctioned plan, the respondents shall take

action, by following due process of law, after issuing notice to the petitioner.

Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
