THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4816 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.4 in the event of his arrest in Crime No.139 of 2022 on the file of Station House Officer, Mangalhat Police Station, Gosha Mahal Division, Hyderabad, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(C) of NDPS Act.

Heard learned counsel for petitioner/Accused No.4 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution is that Accused Nos.1 and 2 were found in possession of 21 kgs of ganja.

Learned counsel for the petitioner submits that on the basis of confession, the police implicated the present petitioner on the ground that at the instance of Accused Nos.1 and 2, this petitioner and three others had in fact helped Accused Nos.1 and 2 in packing into sachets and selling the ganja. Apart from the alleged
confession of Accused Nos.1 and 2, there is no other investigation in respect of this petitioner. He further submits that the petitioner's marriage is scheduled this month.

In the said circumstances, when there are no seizures or no criminal antecedents against this petitioner/Accused No.4 is concerned, she can be granted the relief of anticipatory bail. 6.
Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.4 shall be enlarged on bail in the event of her arrest subject to the following conditions: i) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Mangalhat Police Station within one week from today, and on such surrender, she shall be enlarged on bail on her executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.
ii) The petitioner/Accused No.4 shall appear before the concerned Station House Officer on every 1st and 3rd Mondays between 10.30 AM and 01.00 PM for a period of three (03) months.
iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 7.
As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
