THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.12697 of 2015 ORDER:

This Criminal Petition is filed by the petitioner under Section 482 Cr.P.C seeking to relax the conditions i.e., "(i) Not to leave the State of Andhra Pradesh without prior permission from the learned trial Court and (ii) to deposit his passport before the learned trial Court" imposed upon the petitioner vide order dated 21-07-2015 made in Crl.M.P.No.1522 of 2015 in C.No.VIII/48/02/2015-SIIB CPC on the file of the Hon'ble Court of the Special Judge for Economic Offences at Hyderabad.

Heard the learned counsel for the petitioner and the learned Public Prosecutor and perused the material available on record. Considering the facts and circumstances of the case, the Criminal Petition is disposed of as follows : i.

The petitioner is directed to file an affidavit before the Court concerned informing the date on which he wants to leave India for the purpose of his business and on such affidavit being filed, the learned trial Court is directed to return the passport to the petitioner and further, the petitioner is directed to surrender the passport after his visit to foreign country. (ii) Insofar as the condition i.e., "the petitioner shall not leave the State of Andhra Pradesh without prior permission from the learned trial Court" is concerned, is hereby relaxed.
