THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.3525 of 2004 ORDER:

The writ petition is filed seeking a writ of Mandamus or any other appropriate writ (i) declaring the action of the respondent in changing the service conditions of the petitioner consequent to the transfer from Bellampalli area to Bhoopalpalli area is illegal and arbitrary; (ii) declare the respondents in utilizing the services of the petitioner as General Mazdoor (underground) at Bhoopalpalli area by the respondents is illegal and arbitrary (iii) declare the proceedings No.BHP/PER/10/1503 dated 04.08.2003 is illegal and arbitrary. At the time of hearing, learned counsel for the petitioner submitted that the age of superannuation in Singareni Collieries Co.Ltd., is 60 years. In the year 2004, the petitioner was aged about 51 years. He further submitted that the petitioner might have retired from service on attaining the age of superannuation and the cause in this writ petition does not survive for adjudication. In view of the submission made by the learned counsel for the petitioner, the Writ Petition is closed.

Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
