HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.11920 of 2006 ORDER:

This Writ Petition is filed seeking to pass an order, direction or a writ particularly in the nature of Writ of Mandamus declaring that the respondent has no right to refuse delay in delivering possession of the house sites allotted to the petitioners by the District Collector, Guntur under Patta Certificates vide Nos.201, 68, 186, 208, 58, 59, 62, 229, 231, 232, 236, 237, 213, 218, 47, 54, 217, 214, 215, 221, 40, 36, 238, 63, 84, 252, 100, 207, 174, 156, 134, 133, 138, 103, 16 and 8 to the petitioners each admn. 61 sq.yards situated at Shabaz Hussaini Nagar, Punnur Road, before Andhra Muslim College, Guntur and consequently, to direct the respondent to deliver the possession of the house sites allotted to the petitioners by the District Collector under the patta Certificates vide Nos. referred above to the petitioners each admin. 61 sq. yards situated at Shabaz Hussaini Nagar, Punnur Road, before Andhra Muslim College, Guntur by putting them into peaceful and vacant possession of the allotted house sites immediately.

Ms.Vasantha, learned Assistant Government Pleader today placed on record the communication from the Municipal Administration Department, Office of the Additional Commissioner Municipal Corporation, Guntur addressing to the Tahsildar, Guntur vide Roc.No.225902/2018-HI, dated 23-6-2018 wherein the Additional Commissioner, Municipal Corporation, Guntur has

categorically stated that the request of the petitioners will be considered in the 2nd phase of NTR Urban Housing. It is pertinent to extract the relevant paras of the said communication vide Roc.No.225902/2018-HI, dated 23-6-2018 which reads as follows:

"In the reference cited above, it was stated that a latter was addressed to Guntur Municipal Corporation vide Rc.No.1130/98-B, dated 06-03-2010 and dispached on 803-2010 wherein requested to accommodate the 36 beneficiaries who are approached the Hon'ble High Court vide WP No.11920/2006 by not shown the possession to the pattas issued by the Tahsildar, Guntur.

In this regard, verified the record and the above letter was not received to this office and they are not accommidated in the Urban Housing Scheme previously. Now, they will be considered in the 2nd Phase of NTR Urban Housing."

In view of the same, this Writ Petition is disposed of directing the respondent to consider the request of the petitioners for allotment of the houses in the 2nd Phase of NTR Urban Housing as expeditiously as possible.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
