This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to grant bail to the petitioner/accused No.2 in Crime No. 1957 of 2025 on the file of Miyapur Police Station, Cyberabad, registered for the offences punishable under Section 8(c) read with 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the respondent-State.

The brief facts of the case are that on 28.12.2025, at about 22:00 hours, on receiving credible information that the accused persons are illegally transporting and selling the contraband to the public to earn money in ease manner, the Police have seized 10.5 grams of MDMA from accused persons near Miyapur X Road, Miyapur, Hyderabad. Hence, the complaint.

Learned counsel for the petitioner firstly submits that the petitioner is innocent and he is falsely implicated in the case. He secondly submits that accused No.1, in the same crime, was enlarged on bail by this Court on 14.05.2026 vide Criminal Petition No.5138 of 2026 subject to certain conditions. He thirdly submits that the petitioner has been languishing in jail since 29.12.2025. He lastly submits that the petitioner is willing and ready to cooperate with the investigation and also ready to abide by the conditions as may be imposed by this Court. Hence, learned counsel prays this Court to allow the Criminal Petition by granting bail to the petitioner.

Per contra, learned Additional Public Prosecutor contended that the petitioner/accused No.1, along with other
accused, committed grave offence under the provisions of NDPS Act. Hence, he prays this Court to dismiss the Criminal Petition.

In the light of submissions made by both the parties and upon perusal of the material available on record, it is noteworthy that accused No.1 was enlarged on bail in the same crime with similar allegations vide orders dated 14.05.2026 in Criminal Petition No.5138 of 2026. 7.
Considering the facts and circumstances of the case and since the petitioner is languishing in jail from 29.12.2025, this Court deems it fit to grant bail to the petitioner/accused No.2 subject to the following conditions:
1) The petitioner/accused No.2 shall execute a personal bond for Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of the learned VIII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar.
2) The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m., and 05:00 p.m., for a period of eight
(8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter as and when required.
3) After release, if the petitioner/accused No.2 indulges in similar offence, the respondent-State is at liberty to file an application seeking cancellation of the bail granted to him by this Court.
4) The petitioner shall abide by the other conditions stipulated in Section 480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. 8.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
