HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.36646 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking the following relief: " .... to issue a writ or order or direction, more particularly one in the nature of writ of mandamus declaring the action of the respondents in interfering into the peaceful possession and enjoyment of the agricultural land of the petitioner to an extent of Ac.1.12 in Sy.No.1374/1 situated at Reddyvaripalli Village, Hamlet of Balaiahgari palli village, Kalakada Mandal, Chittor District is arbitrary bad and illegal and violation of the principles of natural justice and Article 14 and 300 A of the constitution of India, consequently direct the respondents 1 to 4 not to interfere into the peaceful possession and enjoyment of the petitioner's agricultural land to an extent of Ac.1.12 in Sy.No.
1374/1 situated at Reddyvaripalli village, Hamlet of Balaiahgari palli village, Kalakada Mandal, Chittoor District, where in exists the ground nut crop, in the interest of justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue (AP) for respondents 1 to 4. With their consent, the writ petition disposed of at the stage of admission itself.
The limited grievance of the petitioner is that the respondent authorities are trying to interfere with his peaceful possession over the agricultural land admeasuring Ac.1.12 in Sy.No.1374/1 situated at Reddyvaripalli Village, Hamlet of Balaiahgari palli
village, Kalakada Mandal, Chittor District, on the premise that the same is government land.
Learned AGP asserts that no action or dispossession would take place without issuing a notice to the petitioner. Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondents not to take any coercive steps for dispossessing the petitioner without following due process of law, if the petitioner is in possession of the property.
