THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.9025 of 2017 ORDER:

This criminal petition is filed, by the petitioner/accused, under Section 438 Cr.P.C., seeking anticipatory bail in Crime No.32 of 2017 on the file of the Station House Officer, Sadashivapet Police Station, Sangareddy district registered for the offences punishable under Section 420 of IPC.

The learned counsel for the petitioner strenuously submitted that the petitioner was falsely implicated in the case. Per contra, the learned Public Prosecutor representing the State submitted that the petitioner misappropriated the Society money to the tune of Rs.15.00 lakhs, therefore, this is not a fit case to grant anticipatory bail to the petitioner.

The case of the prosecution is that the petitioner has been working as Manager in the toddy shop of the de-facto complainant. It is the further case of the prosecution that the petitioner had taken away an amount of Rs.15.00 lakhs from the toddy shop of the defacto complainant without paying salaries to the employees. Basing on the complaint lodged by one Srinivas Goud, the above case was registered.

The petitioner filed Crl.M.P.No.770 of 2017 on the file of the Court of the Principal District & Sessions Judge, Medak at Sangareddy and the same was dismissed on 29.08.2017. A perusal of the record reveals that the petitioner worked as Manager in the toddy shop of the de-facto complainant for a period of 20 years. A perusal of the record prima facie reveals the role played

by the petitioner in commission of the alleged offence. The gist of the complaint is that the petitioner cheated the de-facto complainant. Having regard to the nature of the offence alleged to have been committed by the petitioner and the stage of the investigation, this Court is of the considered view that this is not a fit case to grant anticipatory bail to the petitioner.

In the result, the petition is dismissed.
