ORDER:

This writ petition is filed for a mandamus to declare the action of respondent No.2 in awarding contract relating to sweeping and cleaning of buses in Atmakur bus depot in favour of respondent No.3 as illegal and arbitrary. A perusal of the impugned notification shows that the initial period of contract is described as two years with a provision to extend the same by three more years based on the performance of the contractor. As this Court has granted an interim order on 03.08.2012, restraining respondent Nos.1 and 2 from issuing work order to respondent No.3, the contract was not awarded to respondent No.3. As the initial contract period itself has expired and respondent No.3 was not awarded the

contract, respondent Nos.1 and 2 have to necessarily issue a fresh tender notification.

In this view of the matter, the writ petition is disposed of with the direction to respondent Nos.1 and 2 to issue a fresh notification. As and when such notification is issued, the petitioner and respondent No.3 shall be free to file their tenders. As a sequel to disposal of the writ petition, W.P.M.P.No.30529 of 2012 shall stand disposed of as infructuous.
