HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7468 OF 2015 ORDER:

Challenging the inaction of the 2nd respondent in disposing of the Appeal No.F1/2204/15 filed by the petitioners, the present writ petition is filed.

The grievance of the petitioners is that they had filed an Appeal No.F1/2204/15 before the 2nd respondent-Joint Collector against the order dated 17.01.2015 passed by the 3rd respondent in Case No.J/1692/2013. The petitioners had also filed stay petition along with the appeal seeking stay of the order dated 17.01.2015 of the 3rd respondent. It is stated that 2nd respondent did not choose to either pass any orders in the stay petition or to dispose of the appeal preferred by the petitioners. Hence, the writ petition. Heard Sri A. Kranti Kumar Reddy, learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioners submits that there is an urgency in the matter and the petitioners are in possession and enjoyment of the property in question. He further submits that there is every likely hood that the petitioner being dispossessed from the possession of the property on account of the order dated 17.01.2015 of the 3rd respondent and hence he prays to allow the writ petition. Having considered the limited grievance of the petitioners and also in view of the fact that the petitioners are in possession and enjoyment of the property in question, without expressing any opinion, the writ petition is being disposed of with a direction to the 2nd respondent to pass appropriate orders either in the stay petition or in the appeal filed by the petitioner within a period of four weeks from today. Till such time, status quo shall be maintained by all the parties concerned.

With the above direction, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed.
