THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25903 of 2015 ORDER:

The petitioner is a permanent fair price shop dealer of shop No.33, Chakrayapalem Village, Addanki Mandal in Prakasam District. The authorization of the petitioner was valid up to 31.03.2015 and he remitted the challan on 17.04.2015 for its renewal. The Food Inspector, Addanki, inspected the shop on 17.05.2015 and submitted a report to the third respondent on 19.05.2015. Based on the said report, a show cause

notice was issued to the petitioner on 27.05.2015 framing two charges, and the petitioner submitted his explanation on 16.06.2015. After hearing the learned Counsel for the petitioner, an order of cancellation of authorization was passed on 04.08.2015 by the third respondent. Challenging the same, the petitioner preferred an appeal to the second respondent on 07.08.2015 along with a stay petition. When the stay petition was not disposed of, the present Writ Petition is filed. In view of the pendency of the appeal before the second respondent, this Court is not inclined to go into the merits of the case. In coming to the said conclusion, this Court is conscious of the charges leveled against the petitioner.

In the circumstances, this Writ Petition is disposed of directing the second respondent to consider the stay petition filed along with the appeal on 07.08.2015, and pass appropriate orders thereon, within a period of one week from the date of receipt of a copy of this order. The second respondent shall also consider the main appeal and pass final orders thereon after giving due opportunity to the petitioner, within a period of two months from the date of receipt of a copy of this order. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
