HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5299 OF 2019 ORDER:

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') is filed by the petitioner - accused viz., Kotla Kishore, seeking to recall / suspend the order of Non-Bailable Warrant dated 16.04.2019 issued against him by the learned III Special Magistrate, Hastinapuram, L.B. Nagar, Ranga Reddy District, in C.C. No.151 of 2018.

2. Heard Sri Vijay Kumar Panuganti, learned counsel for the petitioner, and learned Additional Public Prosecutor appearing for the State, and perused the material on record.

3. Though the learned counsel for the petitioner filed the present petition for recalling or suspension of the aforesaid order, he restricted the prayer seeking a direction to the petitioner to surrender before the trial Court and move an application to recall the aforesaid order of Non-Bailable Warrant issued against him.

5. In view of the prayer made by the learned counsel for the petitioner, the petitioner is directed to surrender before the Court concerned within eight (8) weeks from today and move an application to recall the aforesaid order of Non-Bailable Warrant dated 16.04.2019 and on filing such an application, the trial Court shall consider the same and recall the Non-Bailable Warrant on condition of petitioner executing a personal bond for a sum of Rs.50,000/-

(Rupees fifty thousand only) with two (2) sureties for a like sum each to its satisfaction.

6. With the above directions, the Criminal Petition is disposed of.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the criminal petition stand closed.
