THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT APPEAL NOs.986, 1009 AND 1017 OF 2016 COMMON JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} By the order under challenge in these three Writ Appeals, the delay in invoking the jurisdiction of the Andhra Pradesh Co-operative Tribunal, Visakhapatnam was condoned on condition that costs of Rs.10,000/- was paid to each of the respondents.

Ms. V.Uma Devi, learned counsel for the appellants, would submit that the appellant is facing a severe financial crunch, and mulcting them with a huge liability, towards costs, of more than Rs.2 lakhs is not justified. Both Dr.P.B.Vijay Kumar and Sri P.V.Vidyasagar, learned counsel for the respondents, would fairly state that reasonable costs may be directed to be paid by the appellant to the respondents herein.

We consider it appropriate, in such circumstances, to modify the order of the learned Single Judge only to the limited extent that costs of Rs.10,000/- was directed to be paid to each of the private respondents. The appellants herein shall, instead, pay Rs.5,000/- (Rupees five thousand only) to each of the private respondents within four (4) weeks from today.

With the aforesaid modification all the three Writ Appeals are disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
