This Criminal Petition is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, "BNSS"), seeking to grant regular bail to the petitioner, who is arrayed as sole accused in Crime No.451 of 2026, on the file of Rajendranagar Police Station, Hyderabad registered for the offences punishable under Sections 69, 318(4), 308(2) and 238 of BNS, 2023.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor appearing for the respondent -State. 3.

The brief facts of the case are that on 07.05.2026, the petitioner/accused along with the defacto complainant are acquainted with each other for about 10 years. Despite knowing

the fact that the complainant was married, the petitioner developed close relationship with her from 2017-18 and thereafter engaged in sexual intimacy with her on the false promise of marriage and also captured her nude photographs and blackmailed her husband, which lead to their divorce and extorted approximately an amount of Rs.50,00,000/- from her and subsequently assaulted her. Hence, the complaint. 4.

Learned counsel for the petitioner/accused contended that all the allegations are falsified and there is no iota of truth in the said allegations. In fact, it is a consensual relationship between the petitioner/accused and the defacto complainant as they are majors and both got divorce and had intimacy with each other and that the petitioner was arrested on 07.05.2026 and languishing in judicial custody since then and prayed to grant the bail.

Learned Additional Public Prosecutor would contend that in fact, the petitioner/accused has taken undue advantage of their intimacy and had also exploited her by extorting money of Rs.50 lakhs approximately. In that view of the matter learned Additional Public Prosecutor would contend that it is not a fit case for enlarging the petitioner/accused on bail.

Evidently, the complaint itself stages that the complainant along with the petitioner/accused developed intimacy from 201718 and though it is stated that the petitioner/accused extracted amount from the petitioner, however, the same could only be revealed by conducting investigation and the fact remains that the petitioner/accused was arrested on 07.05.2026 and has been languishing in judicial custody since then.

In view of the above stated facts and circumstances of the case, this Court is of the considered opinion that it is a fit case to enlarge the petitioner/accused on bail subject to the following conditions:- (i) The petitioner/accused shall be enlarged on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five thousand only) with sureties for like-sum each to the satisfaction of the learned X Additional District & Sessions Judge at Rajendranagar, Ranga Reddy District.

(ii) The petitioner/accused shall appear before the respondent- Police Authorities on every Sunday between10.00 A.M. and 2.00P.M. for a period of 8 weeks or till filing of the charge sheet whichever is earlier.

(iii) The petitioner/accused shall not in any way approach the defacto complainant and shall not hamper with

the investigation and shall not in any way meddle with any of the witnesses and shall cooperate at all times whenever called by the Police for investigation.

(v) The petitioner/accused shall abide by the conditions stipulated under Section 480(3) of the BNSS.

(vi) In the event of breach of any of the above conditions, the prosecution is at liberty to file appropriate application for cancellation of bail granted to the petitioner.

Miscellaneous applications, pending if any, shall stand closed.
