HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21097 of 2005 ORDER:

As there was no representation on behalf of the petitioner on 14.09.2015, the matter was directed to be listed today under the caption "for dismissal". Even today also there is no representation on behalf of the petitioner either in the morning or in afternoon session. Hence, heard the Government Pleader for Revenue, perused the record.

The present writ petition came to be filed seeking issuance of writ of mandamus, declaring the action of the respondents in not assigning the land by collecting the nominal rate for the purpose of house sites to the members of the petitioner association, as illegal, arbitrary and contrary to the principles of natural justice; and consequently direct the respondents to allot house sites to the members of the petitioner association. The Government Pleader for Revenue submits that the request of the petitioner association cannot be considered in view of the ban imposed by the Government vide Memo No.2700/HB/II-04. According to him no house sites can be granted within the urban areas. It is stated that the land which is sought for by the petitioner for allotment of house site is situated within the urban limits.

In view of the G.O. issued by the government and on perusal of the record, this Court is of the view that the relief sought for by the petitioner cannot be accepted. Hence, I see no merits in the petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
