HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT APPEAL No. 1452 of 2014 JUDGMENT: (per HACJ) Sri M. Rajender Reddy, learned counsel for the respondent-writ petitioner, would submit that the writ petition was filed to declare the inaction of the 1st respondent in enforcing Section 34 of the A.P. Reorganisation Act, 2014, and issuing necessary instructions to respondents 2 to 4 (the appellant, and respondents 2 and 3 herein) to perform their functions provided in the Advocates Act, 1961, with respect to the Bar Counsel of the State of Telangana, as illegal, arbitrary and contrary to the provisions of the A.P. Reorganisation Act, 2014, and the Advocates Act, 1961; and, consequently, set aside Resolution No.

117 of 2014 of the 2nd respondent, communicated to the 3rd respondent vide BCI:D:2942/2014 dated 21.06.2014, as arbitrary and illegal. Learned counsel would submit that, since the term of office of the office-bearers of the Bar Council of A.P., has come to an end and a Special Committee has been appointed to manage the affairs of the Bar Council, the petitioner does not wish to prosecute the writ petition; and, instead of keeping the appeal pending on the file of this Court, it would suffice if the writ petition itself is dismissed as withdrawn.

In the light of the submission of Sri M. Rajender Reddy, the order under appeal is set aside, W.P.No.24760 of 2014 is restored to file, and is dismissed as withdrawn.
