This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the respondents in not selecting the meritorious petitioner to the post of Senior Treatment Supervisor (STS) in the 1st respondent Organization, as illegal, arbitrary and violation of fundamental rights guaranteed under the Constitution of India under Articles 14, 16 and 21, and consequently to direct the respondents to dehorse the selection process and select the petitioner.

Heard Sri M.Roopender, learned counsel for the petitioner and the learned Government Pleader for Medical and Health. It has been contended by the petitioner that he is fully eligible and qualified to be appointed as Senior Treatment Supervisor. The respondents have issued a notification on 21.03.2015 for filling up of various posts in the 1st respondent organization on contract basis for a period of one year. In all 10 Senior Treatment Supervisor posts were advertised. The petitioner has applied for the post of Senior Treatment Supervisor. Though the petitioner is fully qualified and eligible for the said post, the respondents have not selected the petitioner. In those set of circumstances, the present writ petition is filed. When the matter is taken up for hearing today, the learned Government Pleader has submitted that the tenure of the appointment to the post of Senior Treatment Supervisor is only one year and the period of one year is already over from the date of selection process, and therefore, the cause in this writ petition does not survive.

AKS,J WP_42993_2015 In view of the above submission made by the learned Government Pleader, the cause in this writ petition does not survive as the tenure of the post of Senior Treatment Supervisor, for which the petitioner has applied, was only one year, and the same is already over. Therefore, the writ petition is closed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
