THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.2054_OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Public Prosecutor. Perused the material on record.

2. The present Criminal Petition came to be filed by the petitioner under Sections 397 and 401 Cr.P.C., questioning the docket Order, dated 01.08.2016, passed in Calendar Case No.762 of 2015 by the Judicial Magistrate of First Class at Huzurnagar, Nalgonda District, wherein the learned Magistrate while rejecting the petition filed under Section 317 Cr.P.C., issued Non-Bailable Warrant against the petitioner.

3. Learned counsel for the petitioner mainly submits that the petitioner was present before the Court on every date of adjournment except on 27.07.2016 and his absence on that day was neither wilful nor wanton.

4. Having regard to the fact that the petitioner was present before the Court on earlier occasions, the order issuing N.B.W., is stayed for a period of two (02) weeks from today. Meanwhile, the petitioner shall appear before the concerned Court and make an application for recall of N.B.W., in which event the same shall be considered on such conditions as the Court deems fit. The petitioner is further directed to appear before the Court below on every date of adjournment, failing which, the Court below shall take steps, in accordance with law.

5. Accordingly, the Criminal Revision Case is disposed of.
