HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.509 of 2003 ORDER:
This writ petition is filed to declare impugned Memo No.SE/O/MDK/PO/ADM/DC/DNO.2883, dated 17.10.2002 and consequential Memo No.SE/ O/ MDJ/ PO/ Adm/ DC/ DNO.3203/2002 dated 29.11.2002 issued by first respondent as illegal, arbitrary without jurisdiction and to set aside the same and consequently direct respondents to continue petitioner as Junior Accounts Officer, duly granting all other consequential benefits. When this matter has come up for hearing on 19.11.2015 on the request of learned counsel for petitioner, it was adjourned by one week and again when it has come up on 26.11.2015 on the request of petitioner's counsel, one week further time is granted and when it has come up for hearing yesterday on the request of both sides, it is posted to this day. Today there is no representation for petitioner.
In spite of taking time, petitioner has not evinced any interest in prosecuting this case. As seen from the material papers, petitioner is aged 55 years as on the date of filing of this writ petition and by this time, he must have retired from service, therefore it appears that petitioner is not interested in prosecuting this case. Considering these aspects, the writ petition is dismissed for non-prosecution. Miscellaneous Petitions pending in this writ petition, if any, shall stand closed. __________________ S.
