This Writ Petition is filed for a Mandamus to declare the action of the respondents in issuing Notice, dated 09.01.2016, to demolish the property bearing No.22/278/2, in an extent of 11.15 square meters in Ward No.22, Carvanpet, Adoni Municipality, as illegal and arbitrary.

The petitioners sought for a consequential direction to the respondents not to take any coercive steps without following the due process of law.

Mr.Md.Saleem, learned Standing Counsel for respondent No.2- Municipality, has fairly conceded that W.P.No.1684 of 2016, filed by similarly situated persons, was disposed of by this Court, on 21-022016, with certain directions. He has further submitted that the difference between the said case and the present case is that after issue of the impugned notice, dated 09-01-2016, the petitioners have not submitted any representation.

The learned Counsel for the petitioners, however, submitted that after the markings were made on the petitioners' property, they have submitted a representation on 19-01-2016 and that the same may be treated as a reply to the impugned notice as well.

In the above facts and circumstances of the case, this Writ Petition is disposed of in terms of Order, dated 21.01.2016, in WP.No.1684 of 2016, with the direction that the observations and directions contained therein shall form part of this order.

As a sequel to disposal of the Writ Petition, WPMP.No.3103 of 2016, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 28th January, 2016 lur
