THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5161 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in connection with crime No.50 of 2014 on the file of the Cyber Crime Police Station, DD, CCS, Hyderabad, registered for the offences under Sections 66, 66(c), (d) of the Income Tax Act and Section 120-B, 419, 420, 468, 471 read with Section 34 of IPC.
Heard and perused the records.
Learned counsel for the petitioner submits that the petitioner has not committed any of the offences as alleged by the prosecution. He further submits that the co-accused in the present crime were granted anticipatory bail and as such, the petitioner, being a lady, may also be granted anticipatory bail and that he is ready to abide by the conditions that may be imposed while granting bail.
Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner herein. In the circumstances, the petitioner/A.1 is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties pertaining to the State of Telangana, for a like sum each to the satisfaction of the Magistrate concerned. Further, the petitioner/A.1 is directed to report before the Station House Officer concerned as and when required.
