HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9130 of 2016 ORDER:

This petition is filed by the petitioner - Accused No.1 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in Crime No.20 of 2016 of Maredumilli Police Station, East Godavari District, registered for the offences punishable under Section 8 (c) r/w.20(b)(ii)(c) of the NDPS Act.

Heard and perused the material available on record. The case of the prosecution is that the accused were found transporting 300 kgs., of ganja illegally in a Bolero vehicle. Learned counsel for the petitioner submitted that there is no specific allegation against the petitioner that he was found in possession of the contraband and he was falsely implicated in the case.

Learned Additional Public Prosecutor opposed this petition by submitting that on the instructions of A1 only, the other accused were transporting the ganja in the Bolero vehicle and on his instructions only they followed his bike and he is main person in transporting the ganja illegally.

In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner.
