This Criminal Petitions is filed under Sections 437 and 439 of the Criminal Procedure Code by the petitioner/accused in Crime No.83/2022 on the file of Chikkadapally Police Station, Hyderabad District, registered for the offences punishable under Section 302 of Indian Penal Code.

The case of the prosecution is that the petitioner is alleged to have beaten his son who was in drunken condition. The said deceased son threatened to kill the family members by opening the gas cylinder. In the said process the petitioner enraged by the acts of his son, hit the deceased on his head with hammer and according to learned Assistant Public Prosecutor, 29 injuries are found on the body of the deceased.

As seen from the facts of the case, it is a case wherein the father enraged over his son's act of threatening to kill the family members, attacked the son, apparently, to safeguard his family. 4.

In the said circumstances, the petitioner/accused can be granted bail subject to the following conditions:

i) The petitioner/Accused shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties for a like sum each to the satisfaction of the IX Additional Chief Metropolitan Magistrate, Hyderabad.

ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday and Thursday between 10.30 a.m. and 01.00 p.m. for a period of three (3) months or until filing of charge sheet, whichever is earlier.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
