HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 30956 of 2012 Order:

This writ petition was filed challenging GO Ms No.80, Law (LA&J-Home-Courts.C) Department, dated 13.07.2012, and GO Ms No.221, Finance (SMPC-I) Department, dated 07.08.2012, relating to establishment of Additional District and Sessions Court, at Pithapuram.

2. The writ petition was filed by the Bar Association of Kakinada in the year 2012 and no stay was granted by this Court. The Court at Pithapuram has been functioning since the date of its establishment. The Bar Association which filed the writ petition does not continue and no resolution has been placed before this Court in support of the decision of the Bar Association to file the present writ petition. In view of the functioning of the Additional District and Sessions Court, at Pithapuram, for the last four years and in the absence of valid grounds, this Court is not inclined to interfere with the decision taken by the Government which is in public interest.

3. The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
