THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 1980 of 2007 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not assigning the lands in favour of the petitioner and not considering the representation of the petitioner dated 15.11.2000, as illegal and arbitrary; and consequential direction to the respondents to consider the application of the petitioner dated 15.11.2000 and assign the land.

This Court, while considering W.P.M.P. No.2507 of 2007, held as under:

"Learned Assistant Government Pleader for Revenue (Assignment), after getting instructions, submits that though the petitioner went on making representation for assignment of land in various villages, as there were encumbrances and encroachments, assignment could not be made. He seeks time for filing counter affidavit.

As the representations made by the petitioner were duly given consideration, no purpose would be served by directing the respondents to consider representation/ application dated 15.11.2000. WPMP is accordingly dismissed."

Therefore, the request of the petitioner to consider his representation dated 15.11.2000 cannot be accepted, since the same was considered.

In view of the above, nothing falls for consideration in this writ petition and the same is, accordingly, dismissed as infructuous.

However, it is always open to the petitioner to make applications, in which event, the same shall be dealt with in accordance with law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed.
