THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.27313 of 2009 ORDER:
It is submitted by both the learned counsel that the issue raised in this writ petition is squarely covered by the judgment of this Court in W.P.No.6363 of 2009 dated 06.10.2015. The operative portion of which reads as follows:
"In the light of the above factual matrix and the legal precedents, no case is made out by the writ petitioners warranting interference with the impugned G.O by exercising the power of judicial review under Article 226 of the Constitution of India. Accordingly, all the writ petitions are dismissed.
However, it is open for the petitioners to file applications for exemption as per the provisions of the Act. Since they stated that they have provided required medical facilities and it is for the competent authority to deal with the same, as per law." Recording the said submission made by both the learned counsel, this writ petition is dismissed in terms of the afore-stated judgment of this Court. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
