HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18524 of 2019 ORDER:

The grievance of the petitioner is that respondents are not granting permission for holding condolence meeting on 28-08-2019 at Yellandu, Bhadradri Kothagudem District, Telangana State, following the demise of one Punem Linganna, who is deceased in fake encounter dated 31-07-2019. On that, the petitioner made an application on 20-08-2019 to grant permission for conducting condolence meeting on 28-08-2019. As no action has been taken, the present writ petition is filed.

Heard learned counsel for the petitioner, who, submits that inaction of respondents in considering the application of the petitioner amounts to violation of his fundamental right with regard to freedom of speech and expression, as such respondents are bound to consider the representation of the petitioner and grant permission as requested by him.

On the other hand, Sri Sarath Kumar, learned Special Government Pleader submits that permission will be granted by respondent-authorities on certain conditions that the petitioner to hold meeting in the enclosed hall, should indicate names of speakers and how many persons are going to assemble and that too without arms and ammunition and he should give undertaking that persons from any banned organization will not be present in that meeting and that no statue should be unveiled at the meeting place.

In view of the same, respondent-authorities are directed to consider the application of the petitioner and petitioner has to give

necessary particulars and give undertaking for abiding above conditions as stated supra immediately and on such submission, respondent No.2 shall consider the application of the petitioner for grant of permission forthwith.

Accordingly, the writ petition is disposed of. As a sequel, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-08-2019 Note:
