THE HON'BLE SRI JUSTICE SANJAY KUMAR and THE HON'BLE SMT JUSTICE ANIS WRIT PETITION No.2129 of 2017 ORDER: (per SK, J) Though Sri M. Goutham Kumar, learned counsel representing Sri M. Saleem, learned counsel for the petitioners, would seek an adjournment, we are of the opinion that the writ petition is amenable to disposal at this stage. The writ petition was filed assailing the e-auction-cum-sale notice dated 16.01.2017 published in the newspaper on 17.01.2017 proposing to hold the auction-cum-sale on 01.02.2017.

By order dated 23.01.2017, this Court permitted the State Bank of Hyderabad, respondents herein, to proceed with the proposed auction but directed it not to confirm the auction in favour of the highest bidder for a period of six weeks. It is now represented by Sri Ch. Siva Reddy, learned counsel for the State Bank of Hyderabad, that the auction held on 01.02.2017 did not materialize in an actual sale for want of bidders. SK, J & ANIS, J WP.No.2129 of 2017 notice dated 16.01.2017 is rendered purely academic and does not warrant consideration on merits.

The writ petition is dismissed on this short ground leaving it open to the petitioners to avail appropriate remedies in accordance with law as and when a fresh cause of auction arises. All issues are left open.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
