THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8718 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ order or direction more in the nature of writ of Mandamus; declaring the action of the respondents in not restoring the land an extent of Ac4-16gts forming part of Sy.No.87/A/A, 88/A and 88/M, situated at Kothur village, Bhoothpur Mandal, Mahabub Nagar District, belonging to the petitioner No.1 and also property admeasuring an extent of Ac.7-37 gts forming part of Sy.No.90/A, 91/A/A and 92/A, situated at Kothur village, Bhoothpur Mandal, Mahabub Nagar District, belonging to the 2nd petitioner, to the petitioners, by cancelling the registered sale deed document bearing No. 10079/2015 and No.

10094/2015 both dt: 29-12-2015 got executed pursuant to the G.O.Ms No. 123 dt: 30-7-2015 and the Proceedings dt:

30-12-2015 under reference No. G1/3624/2015 passed by the 2nd respondent, as wholly illegal, unjust enrichment, and unconstitutional besides violation of principles of natural justice and consequently direct the respondents to restore the land to the petitioner and to pass."

In the present writ petition, petitioners are obviously seeking cancellation of the registered sale deeds bearing documents Nos.10079/2015 and 10094 of 2015, dated

AVSS,J W.P.No.8718 of 2017 29.12.2015, executed by the petitioners herein in favour of the respondents.

In exercise of the powers conferred under Article 226 of the Constitution of India, this Court cannot exercise such jurisdiction to set aside the registered sale deeds. However, it is open for the petitioners herein to approach the appropriate forum of law for redressal of their grievance. 4.

With the above observations, without expressing any opinion on merits and demerits of the matter, this writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
