THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.16004 of 2018 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the only grievance of the writ petitioner is noncompletion of investigation into case in Crime No.81 of 2018 and non-filing of the final report/charge sheet, by following the procedure established by law.

I have heard the submissions of Sri Kumbham Srinivas Reddy, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (Telangana), appearing for the respondents 1 to 3. I have perused the material record. 3.

At the hearing, learned counsel for the petitioner submits that if a direction is given to complete the investigation and file a final report and also follow the mandate of the provision of Section 41-A of the Code of Criminal Procedure, 1973, and the precedential guidelines in Arnesh Kumar v. State of Bihar and another1, the ends of justice would be met.

Learned Government Pleader for Home endorses the said submission.

Recording the submissions, the Writ Petition is disposed of directing the Station House Officer, Chaitanyapuri Police Station, Kothapet Fruit Market, Ranga Reddy District/3rd respondent herein, to expedite the investigation into the afore1 (2014) 8 Supreme Court Cases 273

stated crime and file a final report, either way, by following the procedure established by law. He is further directed to follow the procedure contemplated under Section 41-A of the Code of Criminal Procedure, 1973, and the precedential guidelines in Arnesh Kumar's Case (Supra 1) in the matter. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
