THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18533 OF 2019 O R D E R:

The complaint of the petitioner, who claims to be the owner and possessor of land in an extent of 200 square yards in Survey No. 290/3A situated at Garmilla Village, Mancherial Mandal, is that at the instance of the 5th respondent, the authorities of the 2nd respondent Mancherial Municipality have been harassing him though he has been making constructions strictly in accordance with the sanctioned plan dated 19.07.2019.

Heard learned counsel for the petitioner.

Learned Standing Counsel for the 2nd respondent municipality, on instructions, submits that the allegation of the petitioner is not correct and that none of their officers have interfered with the construction activity being carried out by him. Having regard to the submission of the learned Standing Counsel, it is made clear that unless the constructions are being made in deviation of the sanctioned plan, and as long as the sanctioned plan is valid and in force, no oral instructions can be issued to the petitioner to stop the construction and further, without issuing him notice, in writing, and calling for his explanation, no interference shall be made with the said construction activity.
