THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16668 of 2017 O R D E R:
The limited grievance of the petitioners in this writ petition is that questing the order, dated 16.01.2017, passed by respondent No.4-Tahsildar, Kannepalli Mandal, Mancherial District under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, they filed an appeal together with stay application before respondent No.3-Revenue Divisional Officer, Bellampally Division, Mancherial District, but the same is not being disposed of as yet. Hence, this writ petition. The petitioners assert that on the basis of the order, dated 16.01.2017, respondent No.5 herein without having any right claimed compensation with respect to the land, which was assigned in favour of their grandfather and acquired on account of submergence in Muthapoor Village Tank. They further assert that on account of the pendency of the appeal, respondent authorities may consider the claim of respondent No.5 in exclusion to them. Today, when the matter is taken up for consideration, learned Government Pleader submits that the appeal is still pending.
Having regard to the limited relief that is being claimed by the petitioners, the writ petition is disposed of with the direction to respondent No.3 to dispose of the appeal filed by the petitioners,
within a period of six weeks from the date of receipt of a copy of this order, by following due process of law.
Since the petitioners apprehend that the compensation amount would be paid to respondent No.5, they shall approach the Land Acquisition Officer and file their objections under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, which, in turn, shall be considered by the Land Acquisition Officer, in accordance with law, particularly taking into consideration the direction given by this Court to respondent No.3 in this writ petition.
