The petitioner prays for mandamus declaring the action of Respondents Nos.1 to 3 in interfering with civil dispute i.e., custody of minor child between the petitioner and his wife, 4th Respondent herein, as illegal and unconstitutional. 2.
Respondent No.1 filed counter-affidavit stating that on the complaint of 4th respondent-wife, a case in Cr.No.592/ 2012 for the offences under Section.498(a), 363 and 506 IPC was registered against the petitioner herein, and mere registering a criminal case on receipt of a cognizable complaint and conducting investigation as per law, cannot be termed as interference by the police into civil disputes. Further it is categorically averred that 1st Respondent never interfered with the civil disputes.

Sri K.Jyothi Prasad, learned counsel for petitioner, having regard to the stand taken in the counter affidavit, requests the Court to place the stand of the 1st respondent on record and close the writ petition.

The stand of the 1st Respondent is placed on record, and the writ petition is closed accordingly, as no further order is
necessary. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
