SMT. JUSTICE T.RAJANI Criminal Petition No.2524 of 2011 ORDER:

This petition is filed seeking to quash the proceedings in Cr.No.509 of 2010 on the file of II Town Police Station, Visakhapatnam. Heard the learned counsel for the petitioner and the learned Public Prosecutor, who takes notice for the 1st respondent. The 2nd respondent does not appear in spite of service of notice. The learned counsel for the petitioner brings to the notice of this Court the order passed by this Court in Criminal Petition No.565 of 2011 by virtue of which proceedings in above Crime No.509 of 2010 are quashed against A-2, Dadi Ravi Kumar.

A perusal of the complaint shows that A2 and the petitioner herein stand on the same footing. In fact, the petitioner was not found at the spot but her photograph is allegedly found on the pamphlet, hence, petitioner stands on a better footing than A2. Hence, following the order passed in Criminal Petition No.565 of 2011 dated 11.09.2014, and in terms thereof, the proceedings in Cr.No.509 of 2010 are hereby quashed.

In the result, this criminal petition is allowed. Miscellaneous petitions, if any, pending consideration, shall stand closed in consequence.
