Petitioners have agreed by the Memo dated nil-03-2018 of Tahsildar, Nizamsagar Mandal. In this memo, there is reference to the letter written by the Office of Sri Maruti Mandir Salabathpur, District Kamareddy dated 20.11.2017. By this letter, the Tahsildar is informed that lands to an extent of Ac.1.21 guntas in Sy.Nos.17P1, 27, 111, 103, 211; Ac.0.53 guntas in Sy.Nos.108, 102, 170; Ac.0.331⁄2 guntas in Sy.Nos.123, 235, 249 of Venglampally, Telagapoor, Singtham, Rangapoor villages, Nizamsagar Mandal, Kamareddy district are endowment lands and the same is reflected in the revenue records and requested to issue pattadar pass books and title deeds in favour of temple.

In response to the Memo, petitioners claimed to have submitted application to furnish information referred to by the temple authorities in their letter addressed to Tahsidlar dated 20.11.2017. Learned counsel for petitioners submits that so far said letter is not furnished. In the absence of earlier communication referred to in the said letter, petitioners could not have made effective explanation. According to the learned Government Pleader, the land belongs to Endowment Department and is not a private land. 2.

Having regard to these submissions, without expressing any opinion on merits, writ petition is disposed of, directing the Tahsildar to obtain letter of Assistant Commissioner, Endowment Department, Nizamabad, dated 26.09.2017 referred to by Sri Maruthi Mandir Salabathpur in their letter addressed to Tahsildar dated 20.11.2017 and communicate the same to the petitioners. After letter is furnished, petitioners shall submit their explanation within a period of two weeks from the date of receipt of letter. The Tahsildar shall

- 3 - consider the explanation and pass appropriate orders. Till the orders are passed, no coercive action shall be taken against petitioners. Even after correspondence is furnished to petitioner, if no explanation is filed within the time stipulated, it is open to Tahsildar to take further steps as consequent to Memo dated nil-03-2018. Pending miscellaneous petitions pending shall stand closed. There shall be no order as to costs.
