HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3786 of 2015 ORDER:

Heard.

Alleging that the 4th respondent, at the instance of respondents 5 and 6, is harassing the petitioner and his family members and forcing the petitioner to pay amount to the 6th respondent, the present writ petition is filed.

Learned Government Pleader has received instructions from the 3rd respondent, which state that the 3rd respondent has received complaints from the 6th respondent on 07-01-2015 and 24-012015. He, therefore, entrusted the matter to the 4th respondent for enquiry. The 4th respondent has accordingly made preliminary enquiry and also visited the petitioner's residence, but at that time, the petitioner is not available and he informed the inmates of the petitioner to inform the petitioner to co-operate with the 4th respondent for conducting preliminary enquiry. The petitioner's allegation that the 4th respondent is harassing the petitioner and his family members is totally denied. The instructions further state that there appears to be a business deal between the petitioner and respondents 5 and 6 as is revealed from the preliminary enquiry and after noticing that the dispute between the petitioner and respondents 5 and 6 is purely of civil in nature, the 4th respondent advised the petitioner as well as the 6th respondent to approach competent civil court for appropriate remedy.

Evidently, no crime is registered against the petitioner and after preliminary enquiry, the petitioner as well as respondents 5 and 6 were advised to approach competent civil court. The allegation of the

petitioner that there is any harassment or pressure by the 4th respondent is clearly unsubstantiated.

Hence, the Writ Petition is dismissed. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
