1. This Criminal Petition is filed by the petitioner-accused seeking to quash the proceedings against him in C.C.No.413 of 2015 on the file of the II Additional Judicial First Class Magistrate, Machilipatnam, Krishna District.

2. The petitioner is alleged to have committed the offence punishable under Section 138 of the Negotiable Instruments Act and Section 420 IPC.

3. Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.

4. At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court.

5. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically insisted by the trial Court. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates.
