HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.5332 OF 2019 ORDER:

The operative portion of the order dated 31.07.2019 in Crl.MP.No.748 of 2019 in Crime No.147 of 2019 of P.S. Thallada, Khammam District, reads as under:- "In the result, this petition is allowed and the S.H.O., P.S. Thallada is directed to release the Maruti Suzuki Swift VDI Car bearing No.TS-03-EJ-1053 to the petitioner/owner of the property on his executing a personal bond for Rs.3,00,000/- with one surety for like sum to the satisfaction of the S.H.O. P.S., Thallada in the form of bank guarantee and the S.H.O. P.S., Thallada is further directed to obtain undertaking from the petitioner/owner of the property to produce the above vehicle as and when required and that the petitioner shall not alienate the said vehicle pending the trial of the case, without the leave of the Court."

The petitioner filed this Criminal Petition under Section 482 Cr.P.C. seeking to reduce the surety bond amount for release of Maruti Suzuki Swift VDI Car bearing No.TS-03-EJ-1053. In the light of the prayer made by the counsel for the petitioner, the order dated 31.07.2019 passed by the Special Sessions Judge for the Trial of the Cases under Narcotic Drugs and Psychotropic Substances Act-cum-I Additional Sessions Judge at Khammam, is modified to the extent that instead of furnishing bank guarantee, the petitioner shall furnish personal bond to the tune of Rs.3,00,000/- with one third party surety for like sum.

With this modification, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous applications, if any, pending in this Criminal Petition, shall stand closed.
